AGU Services Terms and Conditions

1. Relationship between Montex swiss AG and users

AGU (Advanced Growing Up) is a registered trade mark owned by Montex swiss AG used for denomination of products and services (the AGU).

By using our Websites, Applications, Products and Services (hereinafter the “Services”), you expressly manifest your agreement to the following AGU Services Terms and Conditions.

The AGU Services Terms and Conditions are binding and constitute the entire agreement between Montex swiss AG and a user. Montex swiss AG is a Swiss company registered at 16 Tramstrasse, CH-9442 Berneck, Switzerland (hereinafter “Montex swiss AG” or “We”).

The AGU Services Terms and Conditions consist of:

• Сookies Policy

As a user of AGU services, you acknowledge and guarantee that:

• you have obtained and read a copy of the AGU Services Terms and Conditions;

• you store the AGU Services Terms and Conditions on a durable media including but not limited to in hard copy; Durable media means any instrument which enables you to store information addressed personally to you in a way accessible for future reference for a period of time adequate for the purposes of the information and which allows the unchanged reproduction of the information stored;   

• you are of age or authorized to use the Services under the law of your country of residence;

• you agree with and do not object with any clause or part of the AGU Services Terms and Conditions;

• by using all or any Services you do not object with any clause or part of the AGU Services Terms and Conditions;

Any objection or contestation to the AGU Services Terms and Conditions (hereafter the "Conditions") will be interpreted as a refusal to agree to the Conditions. IF YOU DISAGREE WITH THESE TERMS AND CONDITIONS, YOU ARE REQUESTED NOT TO USE ANY OF OUR PRODUCTS OR SERVICES.

2. Modification of the AGU Services Terms and Conditions

It is understood between the parties that Montex swiss AG reserves the right, in any case, to modify all or any AGU Services Terms and Conditions to reflect changes in laws or any applicable regulations, and changes to our Services or any event which is deemed sufficient by Montex swiss AG to command such revisions. Revised AGU Services Terms and Conditions shall not apply retroactively but replace and supersede the previous AGU Services Terms and Conditions. We advise you to frequently consult the AGU Services Terms and Conditions and save the latter version on durable media.

3. General Provisions

1. Severability
   If any provision of AGU Services Terms and Conditions is held invalid or unenforceable by a court of competent jurisdiction, the invalid or unenforceable part or provision shall be deemed as unwritten.

2.  Waiver
   Any failure to exercise or late exercise of any right, power, or privilege under the AGU Services Terms and Conditions shall not operate as a waiver; nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof. 
3. Evidence – Electronic communication
   Any notification and communication between Montex swiss AG and you can be realized by any electronic means of communication such as emails. You hereby grant us your express consent for sending you by electronic means of communication any notification through your AGU Account.

4. Governing law – Dispute resolution
   In the event of any controversy or dispute between Montex swiss AG and You arising out of or in connection with your use of any Products and Services (such as our Website, Application etc.) provided by Montex swiss AG, the parties shall immediately resolve the dispute through alternative dispute resolution in good faith and prior to any judicial action.
   Unless otherwise required by applicable law, this AGU Terms of Use and any matters relating to them, including all disputes, shall be governed by the laws of Switzerland and settled in the courts of Berneck (Switzerland).
